Section 49
Rights acquired in case of opposition to the enforcement of mortgage rights
(1) If the mortgagor prohibits or opposes the performance of the mortgagor's rights, the sale of the mortgagor or any other way of carrying out customs in a way that is contrary to this Act, the mortgage agreement or the prevailing law, the mortgagor must apply to the court in the following cases to protect the property of the mortgagor. (a) the mortgaged property has been damaged or is likely to be damaged or has been wrongfully transferred or is likely to be damaged; In relation to an application made under sub-section (1), the court may issue the following order:- (a) restraining the mortgagee or any other person in possession of the mortgaged property from selling the mortgaged property, (b) prohibiting the mortgagee or any other person having information about the mortgaged property To compel any person to appear before the court and to give information regarding the mortgaged property, (c) to compel the mortgagor to hand over the possession of the mortgaged property to the mortgagee, (d) to give possession of the mortgaged property to any person who has received the mortgaged property with the right of mortgage in accordance with this Act Asking the person who took the mortgage to hand over the money.
